All works published in the United States before 1923 are in the public domain. Works published after 1922, but before 1978 are protected for 95 years from the date of publication. If the work was created, but not published, before 1978, the copyright lasts for the life of the author plus 70 years

Copyrights Date published can most usually be found on the copyright page of a book. That page will tell you when the work was copyrighted - and if the book is a first edition, the copyright date will be the same as the date published. If it is a later edition, the date will be different.

Anyone can Sell or publish non copyrighted works.

That's the simple answer

The complicated answer is that copyrights can be renewed and challenged
